Here you will find information about what personal data we collect, for what purposes we do this and how we process it:
What is personal data?
Personal data is subject to data protection law. This is information that relates to an identified or identifiable natural person, for example name, contact details or the IP address used by them. The protection of personal data is regulated in particular by the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG).
For what purposes do we process data?
We process personal data in the context of our client relationships, data from our suppliers or other business partners and from applicants. We receive most of this data from you, for example when you send us an e-mail. If we collect data ourselves, it usually comes from publicly accessible registers (such as the company register, land register, register of beneficial owners and telephone directory) or other public sources of information, in particular websites.
We process the data of our clients and suppliers/business partners to
- fulfil our pre-contractual and contractual obligations (Art. 6 para. 1 lit. b GDPR),
- fulfil legal and professional obligations (Art. 6 para. 1 lit. c GDPR), for example for notifications to the Bar Association as part of a fiduciary relationship, or to
- protect the legitimate interests of us, you or third parties (Art. 6 para. 1 lit. f GDPR), for example to inform you about important legal developments or to avoid other legal risks.
Where possible, we obtain your express consent to the processing of data, in particular the disclosure of data to third parties (Art. 6 para. 1 lit. a GDPR). The processing of client relationships is not possible if you object to the processing of personal data.
How long do we store data?
In principle, we only store your personal data for as long as we need it to fulfil the purposes described above and our contractual and legal obligations. When we no longer need your personal data, we delete it from our systems and records or anonymize it so that you can no longer be identified.
At the end of the tenth calendar year after the end of a client relationship, we generally destroy our files and permanently and completely delete electronically stored data. After this period, we can no longer provide you with copies of certificates or documents. If we are to store data for longer, we require an express written order to do so.
Do we pass on data to third parties?
As Austrian attorneys, we are obliged to treat all information as strictly confidential. We will therefore only pass on data to third parties if this is necessary or if we are obliged to do so due to legal or professional requirements. On a case-by-case basis, we may have to pass on data to the following persons
- other attorneys/law firms, notaries, chartered accountants, management consultants or experts in Austria and abroad within the scope of client relationships, in particular also as legal representatives of (procedural) opponents.
- courts and authorities in Austria and abroad in the context of client relationships;
- Vienna Bar Association (Austria) for compliance with legal and professional obligations, in particular for the handling of trusteeships and compliance obligations;
- banks and insurance companies; and
- service providers (IT service providers, telecommunications companies, consulting firms, translation agencies, etc.).
Can I revoke my declaration of consent?
You can instruct us to stop processing your data at any time using the contact details below. Even if you have consented to the processing of data in the past, you can withdraw such consent at any time (Art. 21 GDPR). Please note that a revocation may have an impact on existing client relationships.
What other rights do I have to my data?
You have the right at any time to
- request information about which of your data we process (Art. 15 GDPR),
- request the rectification or erasure of your data (Art. 16 and Art. 17 GDPR),
- request the restriction of the processing of your data (Art. 18 GDPR), and to
- request the transfer of your data (Art. 20 GDPR), and to
- lodge a complaint with a supervisory authority, in particular the Austrian data protection authority (www.dsb.gv.at) or the data protection authority at your place of residence
Cookies
Some of the internet pages use so-called cookies. Cookies do not damage your computer and do not contain viruses. Cookies are used to make our website more user-friendly, effective and secure. Cookies are small text files that are stored on your computer and saved by your browser.
Most of the cookies we use are so-called “session cookies”. They are automatically deleted at the end of your visit. Other cookies remain stored on your end device until you delete them. These cookies enable us to recognize your browser on your next visit.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be restricted.
Server Log Files
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are
- Browser type and browser version
- Operating system used
- Referrer URL
- Host name of the accessing computer
- Time of the server request
This data cannot be assigned to specific persons. This data is not merged with other data sources. We reserve the right to check this data retrospectively if we become aware of specific indications of unlawful use.
